# Can You Fax an Absentee Ballot in 2026? State Rules

Sep 17, 2026 [![Mircea Rilă](https://singlefax.com/images/authors/mircea-rila.jpg)Mircea Rilă](https://singlefax.com/authors/mircea-rila)

Learn when a voted absentee ballot may be returned by fax, who qualifies under UOCAVA, what forms to include, and where to verify the fax number.

Only when that election office accepts a faxed ballot. Confirm the number on the official instructions.

![Can You Fax an Absentee Ballot in 2026? State Rules](https://singlefax.com/images/versioned/23677cbfbe6abae1/how-to-fax-an-absentee-ballot-2026.jpg)

**Not every state allows a voted absentee ballot to be returned by fax.** Where fax return is available, it is usually limited to eligible UOCAVA voters and may require an oath, identification sheet, witness, or secrecy waiver.

Start with [FVAP’s instructions for your state](https://www.fvap.gov/uploads/FVAP/States/eVAG.pdf), then confirm the return method, fax number, required pages, and deadline with your local election office.

> This article provides general information, not legal advice. Follow the current packet and official instructions from your election office. Governing law controls; if official sources conflict, contact the issuing election office before transmitting.

## Which source to trust

For actionable election rules, use this order:

1. **Governing law** and the current **state or county election agency** page for your jurisdiction
2. **Your ballot packet** and written instructions from the issuing election office
3. **[FVAP](https://www.fvap.gov/uploads/FVAP/States/eVAG.pdf)** for UOCAVA guidance
4. **[NCSL](https://www.ncsl.org/elections-and-campaigns/electronic-ballot-return-internet-voting)** as a secondary snapshot only

For federal elections, [52 U.S.C. § 20302](https://www.law.cornell.edu/uscode/text/52/20302) requires states to establish mail and electronic procedures for transmitting validly requested blank ballots to UOCAVA voters, using the voter’s designated transmission preference. Federal law does **not** require electronic return of voted ballots. Every jurisdiction provides a mail-return method for UOCAVA voters, subject to its own receipt or postmark deadline. Fax, email, and portal return depend on state law.

**FVAP no longer relays ballot faxes.** Its DoD Fax Service ended **1 August 2025**. Where fax return is permitted, send directly to the official fax number published by your state or county election office—not to FVAP.

---

## Checklist before you fax

1. Confirm you are eligible for fax return under your state’s current rules.
2. Use the **return fax number** from your packet, FVAP, or the election office — not a general clerk line and not FVAP.
3. Include every required page: ballot, oath, identification sheet, witness signature, or FWAB voter-information page.
4. Preserve the required page order, dimensions, and legibility. Combine files only if the packet and fax service permit it. Use wet-ink signature where the packet requires it.
5. Upload at [Send or receive a fax](https://singlefax.com/send-or-receive-fax). Overseas senders can enter `+1` and the 10-digit US number; see [international → US faxing](https://singlefax.com/blog/international-to-us-faxing-guide).
6. Keep the transmission report and promptly check receipt or ballot status with the election office. The report records the vendor-reported transmission result; it does not prove complete or timely receipt by the election office, acceptance, or counting.

Ballot faxes use standard [pay-per-send](https://singlefax.com/send-or-receive-fax) pricing, currently **$0.99 for up to 10 billable pages**. SingleFax does not choose your contests, pick your county, or certify UOCAVA eligibility. If New Jersey requires a mailed copy as well, the fax does not replace the envelope.

## Three different packets

Do not mix these up. Your state page in the [2026–2027 Voting Assistance Guide](https://www.fvap.gov/uploads/FVAP/States/eVAG.pdf) says which methods work for each.

| Packet | What it is | Typical fax rules |
| --- | --- | --- |
| **FPCA** (SF-76) | Registers eligible UOCAVA voters and requests absentee ballots | Submission methods vary by state; many accept fax. |
| **State absentee ballot** | The official ballot your county sent | Fax return is state-specific and often the most restricted option. |
| **FWAB** (SF-186) | Backup federal write-in ballot if the state ballot will not arrive in time | Return methods and required pages are state-specific. |

## NCSL fax-return snapshot (30 June 2026)

The table below summarizes [NCSL’s secondary table](https://www.ncsl.org/elections-and-campaigns/electronic-ballot-return-internet-voting). It is not a substitute for your packet or election office.

NCSL marks fax return for: Alaska, Arizona, California, Colorado, Delaware, Florida, Hawaii, Indiana, Iowa, Kansas, Louisiana, Maine, Massachusetts, Mississippi, Missouri, Montana, Nebraska, Nevada, New Jersey, New Mexico, North Carolina, North Dakota, Oklahoma, Oregon, Rhode Island, South Carolina, Texas, Utah, Washington, and West Virginia — plus Washington, D.C., and the U.S. Virgin Islands.

**Count note:** NCSL calls these “32 states,” while its table comprises **30 states** plus D.C. and the U.S. Virgin Islands.

### Examples of material restrictions

| Jurisdiction | What current sources say |
| --- | --- |
| **Alaska** | [FVAP AK](https://www.fvap.gov/guide/chapter2/alaska): fax the state ballot or FWAB **only if** you requested the ballot by fax or online delivery. [Alaska Division of Elections](https://www.elections.alaska.gov/voter-information/absentee-and-early-voting/) requires the ballot, signed Voter Certificate and Identification sheet, at least one identifier, and an adult witness signature; returning by fax **waives the secret ballot** and must arrive by **8:00 p.m. Alaska time on Election Day**. |
| **California** | [Elec. Code § 3106](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=ELEC&sectionNum=3106.): overseas (outside the US or DC) **or** military called to service **on or after the seventh day** before the election. The ballot must arrive by the close of polls and include the identification envelope information and Oath of Voter. |
| **Florida** | NCSL / FVAP: fax only if the voter is **outside the United States**. |
| **Iowa** | Overseas uniformed-service members may return by mail, email, or fax. Other UOCAVA voters must mail unless located in a hostile-fire area. |
| **Louisiana** | NCSL reports fax return for qualifying absentee voters when requested with the absentee application and the voter believes mail will not arrive in time. Confirm the current state instructions. |
| **Maine / Massachusetts** | Fax column is **UOCAVA only** (other groups may have email or a portal). |
| **Missouri** | Email or fax **only from a hostile-fire area**. |
| **Texas** | Fax **only from a hostile-fire area**; FVAP does not list email return. |
| **Nebraska** | Email/fax only with **prior approval** from the local election official. |
| **New Jersey** | Email or fax, then **immediately mail** the original ballot to the Board of Elections. |
| **Rhode Island** | Fax only if the ballot was **requested via fax**. |
| **Utah** | Sources conflict: [Utah’s voter page](https://vote.utah.gov/military-and-overseas-voters/) and NCSL list fax return, while FVAP’s 2026–27 guide omits fax for state ballots and FWAB. Obtain current instructions from the county clerk before faxing. |
| **West Virginia** | Fax is available to UOCAVA voters; other qualifying groups may use a portal instead. |

NCSL shows **Alabama** and **Michigan** with portal return rather than fax. For mail-only states, open your state’s FVAP page and read the separate rows for **registration**, **ballot request**, and **ballot return**.

## California example

California illustrates why both state law and local instructions matter.

1. Confirm you qualify under [§ 3106](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=ELEC&sectionNum=3106.) (overseas, or late-called military).
2. Look up **your** county on the [SOS mailing and fax table](https://www.sos.ca.gov/elections/voter-registration/military-overseas-voters/mailing-military-or-overseas-voters).
3. Fax the **ballot + signed Military or Overseas Voter Return Envelope + Oath of Voter**. Orange County’s [UOCAVA instructions (v.2503)](https://ocvote.gov/fileadmin/VBM-Documents/UOCAVA-EMail-Instructions.pdf) refuse a fax without the oath and ID envelope, refuse **email** ballots, and require receipt by **8:00 p.m. Election Day**. The SOS table and that PDF both list Orange County military/overseas fax **(714) 333-4488** (re-checked **17 September 2026**).
4. The oath includes a **secrecy waiver**. The county then separates the signature from the ballot before tabulation.
5. Confirm receipt or ballot status with the county; a successful transmission report is not an acceptance notice.

County numbers can change. Use the SOS table or your ballot packet the day you send.

## HIPAA and sensitive information

Ballots can contain sensitive personal information, but they are not ordinarily [PHI under HIPAA](https://www.hhs.gov/hipaa/for-professionals/privacy/laws-regulations/index.html). HIPAA Secure Mode is not legally required solely because a document is sensitive. Choose a transmission channel based on official election instructions and the provider’s privacy, security, and retention practices.

---

## Security measures

[NIST IR 7551](https://nvlpubs.nist.gov/nistpubs/Legacy/IR/nistir7551.pdf) discusses voted-ballot return risks, including limited voter privacy on fax. [NIST IR 7711](https://nvlpubs.nist.gov/nistpubs/Legacy/IR/nistir7711.pdf) is a draft aimed at election officials and does not address electronic return of cast ballots; use it only for general fax-technology context.

- **No widely used fax-encryption standard provides universal end-to-end protection.** Online-service safeguards may protect only individual parts of the transmission path.
- **Use a private device and account.** Avoid a shared workplace machine if other people can view the ballot or fax log.
- **Confirm the exact destination** from the packet, FVAP, or an official state/local page.
- **Include every required page.** A transmission can succeed technically while the ballot is rejected for a missing oath, signature, witness, or identification sheet.
- **Use the required cover or oath.** Do not replace it with a generic legal or medical cover sheet, and do not use the SingleFax cover generator for ballots.

California’s § 3106(d) encourages eligible voters to use mail or in-person return when possible and says they **should** fax only when needed to meet the deadline.

## Frequently asked questions

Can I fax my absentee ballot in every US state?

No. For federal elections, states must establish procedures to transmit validly requested blank ballots to UOCAVA voters, but federal law does not require electronic return of voted ballots. The NCSL table updated 30 June 2026 marks fax return in 30 states plus Washington, D.C., and the U.S. Virgin Islands. NCSL’s prose calls these “32 states,” counting D.C. and the Virgin Islands in that headline. Rules change; use FVAP’s current state instructions and confirm with your election office.

Is faxing a ballot a HIPAA fax?

Ordinarily, no. Ballots can contain sensitive personal information, but they are not ordinarily PHI under HIPAA. HIPAA Secure Mode is not legally required solely because a document is sensitive. Follow official election instructions and choose a transmission channel based on the provider’s privacy, security, and retention practices.

Who is allowed to fax a voted ballot?

It depends on state law and voter category. UOCAVA covers qualifying absent active-duty uniformed-service members, qualifying absent Merchant Mariners, qualifying absent spouses or dependents, and overseas voters tied to an eligible former U.S. domicile—not every citizen abroad in every jurisdiction. California, for example, limits fax return to qualifying voters outside the US or DC and military voters called to service on or after the seventh day before Election Day.

What is the fax number for my ballot?

There is no single national destination. FVAP discontinued its DoD Fax relay service effective 1 August 2025. Fax the number in your ballot packet, FVAP’s local-election-office listing, or your state or county election website. California’s county table lists Orange County’s military and overseas ballot-return fax as 714-333-4488 as of 17 September 2026.

Do I still have a secret ballot if I fax it?

A faxed ballot can be linked to the voter during transmission. Some jurisdictions require a signed secrecy waiver. California’s oath expressly waives ballot secrecy for fax return while requiring election officials to separate the voter’s signature from the ballot and protect secrecy during tabulation. Use mail or in-person return when your instructions recommend it and time permits.

Can I email my ballot instead of faxing?

Only where state law and your election office allow email return. Orange County’s current UOCAVA instructions say emailed ballots are not accepted. Texas is fax-only in the hostile-fire circumstance FVAP describes; it does not list email return. Follow the packet you received rather than substituting one electronic method for another.

Should I use an online fax service or a machine?

NCSL groups fax over a telephone line and internet fax in one column, but your state’s instructions control. Whichever method you use, protect the file, verify the destination, include every required form, keep the transmission report, and confirm receipt or ballot status with the election office. A successful fax report does not prove complete or timely receipt, acceptance, or counting.

Rules change; use FVAP’s current state instructions and confirm with your election office."}},{"@id":"https://singlefax.com/blog/how-to-fax-an-absentee-ballot-2026#/schema/question/2","@type":"Question","inLanguage":"en","name":"Is faxing a ballot a HIPAA fax?","acceptedAnswer":{"@type":"Answer","text":"Ordinarily, no. Ballots can contain sensitive personal information, but they are not ordinarily PHI under HIPAA. HIPAA Secure Mode is not legally required solely because a document is sensitive. Follow official election instructions and choose a transmission channel based on the provider’s privacy, security, and retention practices."}},{"@id":"https://singlefax.com/blog/how-to-fax-an-absentee-ballot-2026#/schema/question/3","@type":"Question","inLanguage":"en","name":"Who is allowed to fax a voted ballot?","acceptedAnswer":{"@type":"Answer","text":"It depends on state law and voter category. UOCAVA covers qualifying absent active-duty uniformed-service members, qualifying absent Merchant Mariners, qualifying absent spouses or dependents, and overseas voters tied to an eligible former U.S. domicile—not every citizen abroad in every jurisdiction. California, for example, limits fax return to qualifying voters outside the US or DC and military voters called to service on or after the seventh day before Election Day."}},{"@id":"https://singlefax.com/blog/how-to-fax-an-absentee-ballot-2026#/schema/question/4","@type":"Question","inLanguage":"en","name":"What is the fax number for my ballot?","acceptedAnswer":{"@type":"Answer","text":"There is no single national destination. FVAP discontinued its DoD Fax relay service effective 1 August 2025. Fax the number in your ballot packet, FVAP’s local-election-office listing, or your state or county election website. California’s county table lists Orange County’s military and overseas ballot-return fax as 714-333-4488 as of 17 September 2026."}},{"@id":"https://singlefax.com/blog/how-to-fax-an-absentee-ballot-2026#/schema/question/5","@type":"Question","inLanguage":"en","name":"Do I still have a secret ballot if I fax it?","acceptedAnswer":{"@type":"Answer","text":"A faxed ballot can be linked to the voter during transmission. Some jurisdictions require a signed secrecy waiver. California’s oath expressly waives ballot secrecy for fax return while requiring election officials to separate the voter’s signature from the ballot and protect secrecy during tabulation. Use mail or in-person return when your instructions recommend it and time permits."}},{"@id":"https://singlefax.com/blog/how-to-fax-an-absentee-ballot-2026#/schema/question/6","@type":"Question","inLanguage":"en","name":"Can I email my ballot instead of faxing?","acceptedAnswer":{"@type":"Answer","text":"Only where state law and your election office allow email return. Orange County’s current UOCAVA instructions say emailed ballots are not accepted. Texas is fax-only in the hostile-fire circumstance FVAP describes; it does not list email return.
